CONTEMPORAIN STUDIO, S.L., (hereinafter, “LRV STUDIO“, “We” or the “Studio“) wants to provide users of the website https://lazarorosaviolan.com (hereinafter, the “Website“) with this additional information on personal data protection (hereinafter, “Privacy Policy“). Hereby We inform users of the Website (hereinafter, the “Users“) in a transparent and simple manner about how We process their personal data, the purposes of such processing, the legal basis, retention periods and the rights that can be exercised amongst other issues. This Privacy Policy will always be available to Users on the Website.

1. WHO IS THE DATA CONTROLLER AND HOW TO CONTACT US?

CONTEMPORAIN STUDIO, S.L., a company incorporated in accordance with Spanish law, with registered office at Ronda Sant Pere, 46, local, Barcelona 08010 (Barcelona), holder of CIF number B-63.185.904, registered in the Mercantile Registry of Barcelona in Volume 35568, sheet 115, page 272504, section 8 and entry I/A 1 shall be the company processing personal data of Users of the Website as data controller. Users may contact LRV STUDIO to exercise their personal data protection rights, resolve any doubts about the processing We carry out on their personal data or request information regarding personal data protection by sending an email to info@lazarorosaviolan.com clearly identifying always their request or the right they are exercising.

2. WHAT IS PERSONAL DATA AND PROCESSING?

Personal data is any information relating to an identified or identifiable natural person. An identifiable natural person is any person whose identity can be determined, directly or indirectly, in particular by means of an identifier, such as a name, an identification number, location data, an online identifier or one or more elements of the physical, physiological, economic, cultural or social identity of that person. Processing of personal data is any operation or set of operations that we carry out on personal data, such as the collection, recording, storage, use and disclosure of data.

3. THROUGH WHAT CHANNELS DO WE COLLECT PERSONAL DATA?

We collect Users’ personal data through the following channels:

• Interaction with LRV STUDIO through the different contact channels enabled for this purpose (email and/or telephone); and
• The interaction, use and exploitation that Users make of the Website.

4. WHAT PERSONAL DATA DO WE PROCESS AND FOR WHAT PURPOSES?

4. 1 – Contact Service

Retention period	·         LRV STUDIO will process the Users’ personal data for as long as it is necessary to manage the request for                      information, request or query made by the User.

    

      4.2 – Recruitment 

Purposes	·         Evaluate the User’s application to join LRV Studio as a professional and, where appropriate, hire him/her. ·         Keep the User’s CV in case they do not join LRV Studio to cover possible future vacancies.
Personal data processed	·         Identification data: full name, DNI/NIE/Passport, image. ·         Social data: date of birth, gender, nationality, domicile, marital status, dependents. ·         Contact details: telephone, e-mail. ·         Professional data: academic record, curriculum vitae, work experience, driving licence and professional                          licences, membership of professional associations, publications, references and third-party evaluations                          (professional recommendations from former employers, senior managers and/or co-workers,                                            headhunters). ·         Economic data: salaries, compensations, indemnities and other remuneration concepts and payroll data,                        account number and bank, pension, insurance and retirement plans.
Legitimizing basis	·         The processing of personal data is necessary for the implementation of pre-contractual measures at the                        request of the User and, where appropriate, for the execution of the employment contract to which the                              User would be a party; and ·         The User’s consent, in the event that LRV Studio deems it appropriate to keep their personal data once                            the  selection process has been closed in order to contact them again in the event of possible vacancies.
Retention period	·          LRV Studio will process the User’s personal data for as long as the selection process for which their                                  personal data is processed remains open and, with their consent, for a period of 1 year after the end of                            the selection process or receipt of their CV. ·           After the expiry of the aforementioned periods, LRV Studio will block the personal data in accordance                              with the provisions of the current regulations on the protection of personal data.

 

     4.3 – Analysis of the use, use and improvement of the Website:

Purposes	·         Recognize Users when they return to the Website.
Personal data processed	·         Identification data: IP address; ·         Information on the use and browsing of the Website by the User: login data, page of origin of the visit to the                    Website, pages after the visit of the Website, layers of the Website visited, duration of browsing,                                        recommended  products, data of the browser used and data of the device used.

Retention period	·         LRV STUDIO will process the Users’ personal data for the duration of the storage period of each cookie used                   at any given time or until they withdraw their consent to the use of cookies and in any case for a                                         maximum period  of 24 months.

Purposes	·         Maintain an up-to-date list of all those Users who have requested the rectification or deletion of their data or                  who at any time have opposed some of the data processing we carry out. ·         Prevent the processing of personal data, including its visualization, except for its availability to judges and                      courts, the Public Prosecutor’s Office or the competent Public Administrations, in particular data protection                    authorities, for the enforcement of possible liabilities arising from the processing and only for the limitation                    period of the same. ·         File legal actions or present the corresponding defense before them when this is necessary as a result of                        and/or  in relation to the responsibilities derived from the processing of personal data carried out by LRV                        STUDIO.

Legitimizing basis	·         The processing of personal data is necessary for LRV Studio to comply with its legally enforceable obligations,              in particular the obligations to comply with the principle of proactive responsibility and the blocking of personal           data stipulated in the current regulations on the protection of personal data.
Retention period	·         When LRV STUDIO proceeds to the rectification or deletion of the personal data of the Data Subjects, it will                    proceed to block them, adopting appropriate technical and organizational measures to prevent their processing,            for the limitation period of the responsibilities arising from the processing, specifically, 3 years in terms of                      personal data protection and 2 years in terms of information society services. ·         Upon reaching the maximum limitation periods for the responsibilities arising from the processing, LRV STUDIO            will anonymize or definitively delete the personal data of the Users.

 

5. WHAT RIGHTS CAN USERS EXERCISE IN TERMS OF PERSONAL DATA PROTECTION? 

• Right of access

Users have the right to know whether or not LRV STUDIO is processing their personal data and, if so, the right to know what personal data is being processed and to obtain a copy of it.

• Right to rectification

Users have the right to modify any data that is inaccurate and to complete any data that is incomplete. Whenever they request to rectify any personal data, they must indicate which data they want to modify in particular and provide adequate accreditation.

• Right to opposition

In the cases provided by law, Users may object at any time, for reasons related to their particular situation, to the processing of their personal data by LRV STUDIO when the legitimate basis for such processing is a legitimate interest of LRV STUDIO or the fulfilment of a mission of public interest by the latter. In any case, Users must remember that opposition to the performance of processing based on consent or the execution of a contract will make it impossible for LRV STUDIO to carry out such processing or execute said contract.

• Right of deletion

Users have the right to obtain the deletion of their personal data from LRV STUDIO without undue delay, provided that certain circumstances provided for in the applicable regulations in force are met. This does not mean that the Users’ data will be totally deleted, but that they will be kept duly blocked, i.e. kept in such a way as to prevent their processing except for their disposal of public administrations, judges and courts for the attention of possible liabilities that may have arisen as a result of the processing during the statute of limitations period of the latter. Once this period has passed, the data will be duly anonymized or permanently deleted.

• Right to data portability

Users have the right to receive and/or request that the personal data concerning you and that you have provided be transferred to another data controller other than LRV STUDIO. LRV STUDIO reminds Users that it is only possible to exercise this right when the legitimizing basis for the processing of their personal data is the execution of a contract or the consent of the Data Subject and the processing is carried out by automated means.

• Right to restriction of processing

Users have the right to request LRV STUDIO to suspend the processing of their data (i) when they have disputed the accuracy of their data, while LRV STUDIO verifies such accuracy; or (ii) when they have exercised their right to object to the processing of their data, while verifying whether the legitimate interests of LRV STUDIO prevail over those of the Users. Likewise, this right allows Data Subjects to request LRV STUDIO to keep their personal data when (i) the data processing is unlawful and the User opposes the deletion of their data, requesting instead a limitation of their use; or (ii) LRV STUDIO no longer needs your personal data for the purposes of processing, but needs it for the establishment, exercise, or defense of claims.

When Personal data processing is carried out based on the consent of the Users, the latters shall have the right to withdraw the said consent at any time without affecting the lawfulness of the processing previously carried out based on the consent prior to its withdrawal.

LRV STUDIO does not currently carry out any profiling of Users, nor does it carry out any automated processing of their personal data on the basis of which decisions are made that may legally affect or in a significantly similar way the Users.

Users may exercise their rights free of charge, freely and at any time by communicating it to LRV STUDIO by sending an email to its Data Protection Officer at the following address: and specifying which specific right is being exercised. If the Studio has difficulties in identifying the User, the User may be asked to send an identification document in order to duly confirm their identity and correctly manage their request. In the event that you consider that LRV STUDIO has not correctly satisfied the exercise of your rights, you may file a complaint with the Spanish Data Protection Agency – https://www.aepd.es/es.

6. TO WHOM DO WE DISCLOSE PERSONAL DATA?

Within the framework of the above-mentioned processing, LRV STUDIO does not communicate the Users’ personal data to third parties.

On the other hand, LRV STUDIO may communicate Users’ personal information to third parties in the event of legal compliance, prior administrative or judicial injunction and/or when there is a legitimate interest pursued by LRV STUDIO, such as, for example, the exercise of legal actions that we consider appropriate. In these cases, the Studio may communicate personal data to:

• Courts and Tribunals;
• Tax Administration;
• Spanish Data Protection Agency;
• Government Agencies and Public Administrations; and
• State Security Forces and Corps.

Likewise, LRV STUDIO may communicate to third parties the personal data of Users Processing in the context of the performance of certain commercial operations, including their prior communication, when such communication and any other processing derives from the development of any operation of structural modification of companies or the contribution or transfer of business or branch of business activity. 7. WHO CAN ACCESS USERS PERSONAL DATA?

We adopt the appropriate procedures and information systems and implement the necessary technical and organizational security measures to ensure a level of security appropriate to the risks that may be involved in the processing. We also ensure that our service providers also have adequate security standards for the protection of the personal data to which they have or may have access, in accordance with the applicable data protection legislation in force at any given time. This Privacy Policy for Users may vary over time due to possible changes in criteria followed at any time by the Spanish Data Protection Agency or other data protection control authorities that may be applicable at any given time. LRV STUDIO therefore reserves the right to modify this Privacy Policy in order to adapt it to these criteria, as well as to new case law or legislation.
